Shoposh maintains full ownership of the products until full payment has been obtained.

It is possible to cancel your order if it hasn’t been sent. Contact us and we will help you. If your order has been sent, you will have to return the products in order to receive a refund. The freight will not be refunded. It is not possible to change your order once it has been submitted. This also includes changing the size or color of a product, removing an item, changing the delivery address or payment method. All packages are sent via courier from our brands’ warehouse. Your order will be sent within 1-3 working days after it has been placed. You will receive an email notifying you that your order has been shipped. Packages arrive within 3-10 days after the item has been shipped.

If nobody is at the address when the courier makes the delivery, a note is left in the mailbox and the courier leaves with the package. If delivery is not possible, the package will be returned to us.

You can have your package delivered to your work address if this is more convenient for you. This should just be included as Delivery Address. Please note that it is not possible to make a delivery to a PO box.

RETURNS

Returns policy

We want all our customers to receive high quality products. If there is something wrong with the product you have received or if your delivery is not identical to your order (wrong product or if a product is missing), please contact our customer service. If you send us a mail, please include as many details as possible including your order number as well as a picture if there is something wrong with one of the products.

When we receive the product, we will refund the value of the purchased product, but not the original freight.
All products must be returned in their original packaging with all enclosed documentation and the packaging cannot be broken or in any other way damaged – neither can the product. Otherwise it will not be possible to obtain a refund.

Returns for size exchange can be exchanged only when a different size or a different colour is available. Exchanges for a different item code are  currently unavailable.

You must pay for the freight to return the goods and this must also be arranged by yourself. The goods are your responsibility until they reach our warehouse. Please ensure you pack the return safely to prevent any damage to the products or boxes.

RETURNS ARE ONLY VALID IF A REQUEST TO RETURN IS SENT BY EMAIL WITHIN 3 DAYS OF RECEIVING THE ITEM AND IS SHIPPED WITHIN 7 DAYS.

How to return a product

Please note that when you return a product it is very important to state the order number as well as your name and address. Without these details we will not be able to process your refund. Furthermore, a detailed description of the problem is necessary – if you have a claim.

The return address will be given to you by email which you have to enclose with the returned products.

It can take up to 14 days for us to receive your return, depending on which postal service you use. Once we have received the returned products, we will inspect them and process the refund within 30 days.

By using this site shoposh.com (hereinafter also referred to as only “website”), users’ agree to these Terms and Conditions, and for this reason shoposh invites all users to read them beforehand.

These Terms and Conditions may at any time be updated and / or amended by Shoposh, changes and updates will be notified to the users as soon adopted and will be binding upon their publication in this section in which users are invited to access regularly to check the publication of the most recent and updated General Terms and Conditions of shoposh.com. In the event that the user does not agree, in whole or in part, with these Terms, please refrain from accessing and from using the website.

The products offered for sale on shoposh.com are sold directly by individual Designers (also called: the “Vendors”), without Shoposh becomes part of the purchase contract, which is concluded solely between the user / buyer and the designer / seller; Shoposh, in these cases, operates solely and exclusively as a provider of services (sales promotion and collateral services for sale) in favour of the Sellers. Precisely because the user purchases directly from Designers, in the case where a single purchase includes products of different vendors, the Shipping costs due by the user will be calculated separately for each individual seller, since for each of them there will be a different shipment.
In some cases, the products offered for sale on shoposh.com are sold directly by Shoposh, with registered office in Limassol, Cyprus in which case the sale is concluded and perfected directly between the user / buyer and Shoposh / seller.

For further information on the products and the operation of the site, users can send an email from the contact page. For any other legal information, refer to this section and Privacy Policy.

1. The commercial policy of Shoposh
1.1 Shoposh and sellers have offered for sale on the site shoposh.com their products and conduct electronic-commerce with regard to end-users. Shoposh reserves the right, in the name and on behalf of the Sellers, not to accept and not to proceed to purchase proposals that are not received by consumers and users, however, which do not comply with these Terms and Conditions of Sale.
1.2 These General Conditions of Sale exclusively regulate the offer, transmission and acceptance of the purchase of products on the site between users of the website and Designers, or between users and Shoposh.
1.3 These Conditions of Sale do not regulate the supply of services and / or sale of products by anyone other than Shoposh or Designers, which are on shoposh.com through links, banners or other hypertext links. And recommended for the user, prior to purchase of goods and / or services offered for sale by these third parties, controls the general conditions of sale as neither Shoposh nor Designers will be responsible for the provision of services and / or the sale of goods and / or the conclusion of any other transaction between users and commercial electronics such third parties.

2. How to Buy (acceptance of Terms and Conditions, Privacy)
2.1 The display of products on shoposh.com is simple invitation to offer.
2.2 To purchase one or more products the user has to select them one at a time and add them to the “shopping bag”.
2.3 Conclusion of the product selection, the user can view them all in his / her shopping bag that also report an indication of the essential characteristics of the selected products and their prices.
2.4 To complete the purchase, the user must click the “proceed to checkout” , the user will have to fill out with personal details and then, finally, choose the preferred payment method and proceed with payment.
2.5 Immediately upon receipt of the order, Shoposh will send the user a confirmation e-mail (“e-mail order confirmation”) that does not constitute acceptance of the order proposal; with this e-mail Shoposh informs the ‘buyer to have received the order and it undergoes a process of verification of the data and availability of the products contained therein.
2.6 Any product which has not been given confirmation of shipment because it is unavailable, is not part of the purchase contract; in case of ordered products and resulted not available at the time of shipping, Shoposh will refund the buyer the price of the product within 30 days of the order date.
2.7 The user can at any time check the status of the order by logging on to “Account”.

3. Prices and availability of products

3.1 On Shoposh are offered for sale only top quality products and also luxury. The order constitutes a contract proposal or addressed directly to the individual designer, through the portal shoposh.com, or, in the case of products sold directly by Shoposh directly to the latter.
3.2 The products offered for sale on shoposh.com are purchased by users directly from the Designer or directly from Shoposh, which guarantee to have them in turn procured from manufacturers and fashion houses carefully selected for their stringent quality controls, or to have them produced in strict compliance with all the rules and laws, and ensuring the highest quality and reliability of the products.
3.3 Each product within shoposh.com is accompanied by an accurate and detailed description of its essential qualities; Shoposh does not guarantee that the images and colours of the products correspond exactly to the real ones, as they may be modified depending on the type of PC monitors, Internet browser used by the user.
3.4 The prices of products may be subject to change; before submitting the order the user are therefore requested to verify the exact amount of the final sale price.
3.5 In case of payment by credit card, the financial information provided by the buyer at the time the order (number of credit card / debit card, expiration date) will be sent by encrypted protocol to PayPal which provides electronic payment services, without any other third party gains access to it. Shoposh will use this information only to complete the purchase by the purchaser or to refund the amount already paid in the event of a product not available after payment or in case of exercise of the right of withdrawal, or even if it is necessary to prevent or report to police authorities any fraud perpetrated on shoposh.com.

4. Guarantees
The sale of products on shoposh.com apply the rules applicable by the legislation on legal guarantee of conformity and commercial guarantees for consumer goods in accordance with national and Community legislation, including, in the case of purchases made by users who are Consumers (individuals who access and use this site for personal purposes, unrelated to business, professional or commercial activity) the Consumer Code (Legislative Decree 6 September 2005, n. 206). In particular, will be liable under that legislation: Shoposh, in the event of purchases concluded directly between users and Shoposh, or individual Designers in case of purchases concluded by users directly with individual Designers. 5. Shipping
The orders are processed from Monday to Friday from 9:00 to 17:30. The orders placed on saturday/sunday will be processed on next Monday. Further information on the procedures and deadlines for delivery of ordered products can be found in the e-mail confirming shipment.

6. Customs
If the ordered products on shoposh.com were to be delivered abroad, the buyer may be subject to import duties and taxes, payable once the parcel reaches its destination. Any additional costs for customs clearance is borne by the buyer; Shoposh can not predict the amount of such costs over which he has no control. For information on customs policies of foreign countries, we invite the user to contact the local customs office.

7. Return Policy
Contact our Customer Service from the contact form and notify your intention to return. Please include the Order Number, item(s) code(s), reason for return.
You will receive a Returns Authorization (RA) Number, a short form to fill in, and the documents to attach to the package to return.
Contact the courier indicated by Shoposh and agree on the best time and place for the pick-up.
The designer you purchased from will receive your package and will check that the item is conform with how it was shipped to you.
We will confirm you by email that your return has been accepted.
We will proceed to refund the credit card with which the payment has been made (refund will be made within 30 days, or in line with the credit card policies) and we will retain shipping costs.
The item must not be worn; it has to be in the same conditions as it was received, appropriately packaged in its original box.
Original tags of the item must not be removed. The item must not have been washed or damaged in any way.
Swimwear (bikini bottoms, swim trunks or briefs) and intimate apparel (briefs, boxers) must be tried on over underwear. Returns will not be accepted if the protective hygienic strip has been removed.
Returns must be within 7 days from the day of delivery. Further information on the exercise of this right can be found in the e-mail confirming shipment.

We encourage the user to carefully read the section of the website dedicated to the Privacy Policy which contains all the information relating to the treatment by Shoposh of user personal information. The controller of the information collected through this site is Shoposh, with registered office in Limassol,Cyprus which independently establishes the purposes and methods of treatment, as well as on security procedures to be applied to provide users with the confidentiality, integrity and availability of data.

Optional or compulsory communication of data
The provision of personal data required to Shoposh by the user of the website on different occasions collection can be optional or mandatory; in the first case it is necessary for the pursuit of certain objectives related to its businesses of the site and which are identified later in this statement.

Article 130, paragraph 4, D.Lgs 196/2003

The legislation on the protection of personal data that allows Shoposh, without the need to acquire the user’s explicit consent, may use the user information for direct marketing activities of products similar to those that he has already purchased, provided that the ‘ user himself does not accept this use of his e-mail address released.

The principles
The specification of Shoposh privacy policy is based on the following principles:

2. use the personal data for purposes other than those listed in point 1. only with the express consent of the holder;

Methods of processing of user personal data
The users’ personal data are processed by Shoposh mainly through electronic and computer systems, as well as by Shoposh, these data are processed by the other “controllers”, subjects selected with care for reliability and competence, who carry out operations that are essential to the pursuit connected purposes shoposh.com use of the website (see above, letter. A).
The specific purposes for which the data are processed are summarized from time to time, in the Ex. Art. 13, D.Lgs 196/2003, that the user is invited to accept when he/she releases his personal data in general, the processing of personal data is done by Shoposh, while respecting the principle of strict necessity, for the following purposes :
1. Registration to the site;
2. subscription to specific services offered by the site, such as newsletters;
3. fulfillment of orders and related activities;
4. management of payments, including fraud control in case of payment by credit card, in this case, the data released during the purchasing process (name, surname, address, credit card number, delivery address if different from billing) will be sent to the responsible person in charge of fraud controlPayPal …………… and processed by it solely for that purpose;
5. management of all requests (technical, commercial, on the progress of orders, etc..) of users;
6. request for evaluation for possible placement on the staff of Shoposh, by sending your CV.

In some cases, as expressly mentioned in the data of the user, subject to their consent, will be subject to processing in order to create profiles based on his preferences and his purchases in order to send information targeted to the needs and to the users’ interests. Except in the case provided for by art. 130, paragraph 4, D.Lgs 196/2003 (during which the holder may use the users’ information to send e-mails about products and services similar to those already purchased, unless the user has refused such use), Shoposh can use the users’ data to send advertising about its services and products, only with the users’ consent.

User data will be disclosed to third parties only with user express consent, except in cases where the disclosure is required by law or is necessary for the purposes prescribed by law for the pursuit of which any consent is required; in such cases, the data may be made available to third parties who will act independently and solely for the above purposes (for example, in the event of a request made by the police or by the courts or other competent authorities or to fulfill obligations arising from contract with the user, as is the case of communication to PayPal for payment of the products purchased).

There are, however, treatments for which the law provides the exclusion of consent: for example, Shoposh can treat your personal information without obtaining consent when this is necessary to fulfill a legal obligation or when it is necessary for carrying out its contractual obligations towards the user itself (as in the case where the user has purchased products or has requested specific services through the website shoposh.com).

Finally, your personal data will not be transferred abroad to countries other than those belonging to the European Union, which does not provide a sufficient level of privacy protection. In case this is necessary to provide the services or to conclude a contract with Shoposh for the purchase of products, Shoposh ensures the transfer of personal data to countries outside the European Union that do not provide an adequate level of protection only after the execution of Shoposh conclusion of specific agreements and such entities in accordance with law and regulations.

Shoposh reserves the right to delete the account and all related data if illicit contents is discovered, damaging the image of Shoposh and/or its products and/or any third party, or otherwise offensive, or that promotes illegal activities or defamatory , pornography, inciting violence, or promote discrimination based on race, sex, religion and sexual orientation.

Subjects who process users’ personal data
As has often been pointed out, Shoposh uses third parties for the processing of personal data in relation to specific activities. These third parties have been carefully selected and have experienced, capacity and reliability and offer sufficient guarantees of compliance with the applicable rules on treatment, including aspects of data security, and they are appointed for this purpose “controllers “and carry out their activities according to the instructions given by Shoposh and under its control.
The user data are then processed by the employees of Shoposh assigned to specific services.

Cookies
Shoposh.com can use automatic systems to collect data not directly by the user, such as cookies, which allow to link the user with the personal information registered on the site and are stored on our server and no one can access the information contained therein.
Only Shoposh processes the information collected through cookies, it does so only in anonymous and aggregate form to improve our services and the site in relation to the specific needs and preferences of its members.
The Internet browser still allows the user to delete cookies after each session.
The acceptance of automatic data collection and use of cookies are necessary for the use of the site and its services, including the purchase of products. In the case of deleting cookies, Shoposh can not guarantee the full view of some of its web pages or the provision of some services.

Security
Shoposh takes appropriate security measures in order to minimize the risks of destruction and/or loss, even accidental, of data, unauthorized access or treatment that is not in accordance with the purposes set out in this Privacy Policy; Shoposh can not guarantee that these measures exclude altogether any risks of unauthorized access and/or loss of data: it is good so that the user verify that their computer is equipped with appropriate software protective equipment (such as updated antivirus systems) and that his Internet service provider has taken appropriate measures for the security of data transmission in the network (such as firewalls and spam filters).

Links to other websites
In shoposh.com website there may be links to other websites with which Shoposh may have no connection, and that Shoposh does not control nor have monitoring operations; Shoposh can not, therefore, be held responsible for the content of these sites and rules adopted by them, even with regard to privacy and the processing of personal data during its navigation; Shoposh Privacy Policy, in fact, does not apply to third party websites. Applicable Law
This Privacy Policy is governed by Cypriot law and in particular by the Code regarding the protection of personal data which governs the processing of personal data, also held abroad by anyone resident or located in Cyprus.
